自然資源部擬建立礦山生態修復激勵機制

該機制將遵循“誰修復、誰受益”原則(ze),通過賦予一定期限的自然資(zi)源資(zi)產使用權等激勵機制,吸(xi)引各(ge)方(fang)投(tou)入,推(tui)行(xing)市場(chang)化(hua)運作、開發式治(zhi)理、科學性利用的模式,加快推(tui)進礦山生態修復。

據自然資源(yuan)部官網10月22日消息,為解決我國礦(kuang)山生(sheng)態(tai)(tai)修(xiu)(xiu)復歷史欠賬(zhang)多(duo)(duo)、現實矛盾多(duo)(duo),“舊賬(zhang)”未還(huan)、“新賬(zhang)”又欠等突出問題,破解資金投入不足瓶頸制約(yue),加快推進(jin)(jin)礦(kuang)山生(sheng)態(tai)(tai)修(xiu)(xiu)復,自然資源(yuan)部國土空間生(sheng)態(tai)(tai)修(xiu)(xiu)復司研究起草了《關于建立激勵機(ji)制加快推進(jin)(jin)礦(kuang)山生(sheng)態(tai)(tai)修(xiu)(xiu)復的意(yi)見(征求意(yi)見稿)》,現面(mian)向(xiang)社會公開征求意(yi)見。


礦山修復


  根據上述文件,將遵循“誰(shui)修(xiu)復、誰(shui)受益(yi)”原則,通過賦予一定期限的自然資(zi)(zi)源資(zi)(zi)產使用權等激勵機(ji)制(zhi),吸引(yin)各方投(tou)入(ru),推行市場化運作、開發式治理、科學性利用的模式,加快(kuai)推進礦山生態修(xiu)復。

  (征(zheng)求意(yi)見稿)

  為解決礦山生態修復歷史欠(qian)賬(zhang)多(duo)、現實矛盾多(duo),“舊賬(zhang)”未還、“新(xin)賬(zhang)”又欠(qian)等突(tu)出問(wen)題,按照(zhao)黨的(de)十九(jiu)大“關于(yu)構(gou)建政府為主導(dao)、企業為主體、社會組織和公眾共同參與的(de)環境治(zhi)理體系(xi)”的(de)要求,遵循“誰(shui)修復、誰(shui)受益”原則,通過(guo)賦(fu)予(yu)一定期限的(de)自(zi)然(ran)資源資產使用(yong)權(quan)等激勵機制,吸引各(ge)方投入,推(tui)行市(shi)場(chang)化運作、開發(fa)式(shi)治(zhi)理、科學性利用(yong)的(de)模式(shi),加快(kuai)推(tui)進礦山生態修復,提出以下(xia)意見(jian)。


  一(yi)、據(ju)實核定礦區土地(di)利用現(xian)狀(zhuang)地(di)類

  地方各級自(zi)然(ran)資(zi)源(yuan)主管部(bu)門要結合第三次全國(guo)國(guo)土調查,據實調查礦區土地利(li)(li)(li)用(yong)現(xian)狀、權(quan)屬。對(dui)因(yin)采礦塌陷等確實無(wu)法恢復的農用(yong)地,經(jing)省級自(zi)然(ran)資(zi)源(yuan)主管部(bu)門會同(tong)相關部(bu)門核(he)實并征得土地權(quan)利(li)(li)(li)人(ren)同(tong)意,報(bao)自(zi)然(ran)資(zi)源(yuan)部(bu)核(he)定(ding)后,可(ke)以(yi)變(bian)更為未利(li)(li)(li)用(yong)地,并納入全國(guo)國(guo)土空(kong)間規劃,地方人(ren)民政(zheng)府因(yin)地制宜組織進行生態修(xiu)復和綜合利(li)(li)(li)用(yong)。


  二、科學制(zhi)定礦區(qu)自然資源利(li)用(yong)方案(an)

  開(kai)(kai)展(zhan)礦(kuang)山(shan)生(sheng)(sheng)(sheng)態修(xiu)復,要強化國(guo)土(tu)空(kong)間規劃管控引領作用(yong)(yong)。各級地方政府(fu)編制國(guo)土(tu)空(kong)間規劃時,應充分考慮歷史遺留礦(kuang)區(qu)和(he)生(sheng)(sheng)(sheng)產建設(she)礦(kuang)山(shan)廢(fei)棄礦(kuang)區(qu)土(tu)地利(li)(li)(li)用(yong)(yong)現狀、資(zi)源利(li)(li)(li)用(yong)(yong)潛力、土(tu)壤(rang)環境質量狀況和(he)生(sheng)(sheng)(sheng)態保(bao)護修(xiu)復適(shi)宜(yi)性等,尊重土(tu)地權利(li)(li)(li)人意(yi)見,結(jie)合生(sheng)(sheng)(sheng)態功能修(xiu)復和(he)后續資(zi)源開(kai)(kai)發(fa)利(li)(li)(li)用(yong)(yong)、產業發(fa)展(zhan)等需求,按照宜(yi)農(nong)則(ze)農(nong)、宜(yi)建則(ze)建、宜(yi)水則(ze)水、宜(yi)留則(ze)留的原則(ze),合理確定(ding)礦(kuang)區(qu)內農(nong)用(yong)(yong)地、建設(she)用(yong)(yong)地和(he)生(sheng)(sheng)(sheng)態用(yong)(yong)地等各類空(kong)間的規模、結(jie)構、布(bu)局和(he)時序,制定(ding)礦(kuang)山(shan)系(xi)統修(xiu)復、資(zi)源綜(zong)合利(li)(li)(li)用(yong)(yong)方案,優化礦(kuang)區(qu)國(guo)土(tu)空(kong)間格局。


  三、鼓勵(li)礦(kuang)山土地綜合修復利用

  歷史遺留礦(kuang)山(shan)廢棄國(guo)有建設(she)(she)用(yong)(yong)(yong)(yong)(yong)地(di)(di)修(xiu)(xiu)(xiu)復后擬(ni)改為經營(ying)(ying)性(xing)建設(she)(she)用(yong)(yong)(yong)(yong)(yong)地(di)(di)的(de)(de)(de),允許(xu)在符(fu)合國(guo)土(tu)空間規(gui)劃前提下,以整體(ti)(ti)(ti)“打捆”形式,將礦(kuang)山(shan)生(sheng)態(tai)修(xiu)(xiu)(xiu)復方(fang)(fang)(fang)案、土(tu)地(di)(di)開(kai)發(fa)利用(yong)(yong)(yong)(yong)(yong)方(fang)(fang)(fang)案、土(tu)地(di)(di)供應方(fang)(fang)(fang)案一并通過公(gong)(gong)開(kai)競(jing)爭方(fang)(fang)(fang)式確(que)(que)定(ding)(ding)同一修(xiu)(xiu)(xiu)復主體(ti)(ti)(ti)和土(tu)地(di)(di)使(shi)用(yong)(yong)(yong)(yong)(yong)權(quan)人,賦予其(qi)一定(ding)(ding)期限、一定(ding)(ding)比(bi)例(li)的(de)(de)(de)經營(ying)(ying)性(xing)建設(she)(she)用(yong)(yong)(yong)(yong)(yong)地(di)(di)使(shi)用(yong)(yong)(yong)(yong)(yong)權(quan),并分(fen)別(bie)簽(qian)訂(ding)生(sheng)態(tai)修(xiu)(xiu)(xiu)復協議與土(tu)地(di)(di)出(chu)讓(rang)合同;修(xiu)(xiu)(xiu)復后擬(ni)作(zuo)為國(guo)有農(nong)(nong)用(yong)(yong)(yong)(yong)(yong)地(di)(di)的(de)(de)(de),可(ke)由市、縣(xian)人民政府(fu)或其(qi)授權(quan)部(bu)門以協議形式確(que)(que)定(ding)(ding)修(xiu)(xiu)(xiu)復主體(ti)(ti)(ti),雙方(fang)(fang)(fang)簽(qian)訂(ding)國(guo)有農(nong)(nong)用(yong)(yong)(yong)(yong)(yong)地(di)(di)承包經營(ying)(ying)合同,從(cong)事種植業(ye)、林(lin)業(ye)、畜牧業(ye)或者漁業(ye)生(sheng)產;修(xiu)(xiu)(xiu)復后擬(ni)發(fa)展特(te)許(xu)經營(ying)(ying)項目的(de)(de)(de),按(an)照特(te)許(xu)經營(ying)(ying)有關管理規(gui)定(ding)(ding),修(xiu)(xiu)(xiu)復主體(ti)(ti)(ti)可(ke)優先獲得(de)經營(ying)(ying)權(quan)。對歷史遺留礦(kuang)山(shan)廢棄土(tu)地(di)(di)中的(de)(de)(de)集(ji)體(ti)(ti)(ti)建設(she)(she)用(yong)(yong)(yong)(yong)(yong)地(di)(di),集(ji)體(ti)(ti)(ti)經濟組(zu)織可(ke)自行(xing)投入修(xiu)(xiu)(xiu)復也可(ke)吸引社會資(zi)本參與,修(xiu)(xiu)(xiu)復后符(fu)合國(guo)土(tu)空間規(gui)劃確(que)(que)定(ding)(ding)的(de)(de)(de)工業(ye)、商(shang)業(ye)等經營(ying)(ying)性(xing)用(yong)(yong)(yong)(yong)(yong)途(tu)的(de)(de)(de),可(ke)以出(chu)租、出(chu)讓(rang)用(yong)(yong)(yong)(yong)(yong)于發(fa)展相關產業(ye),并在出(chu)讓(rang)、出(chu)租、轉讓(rang)合同中明確(que)(que)生(sheng)態(tai)修(xiu)(xiu)(xiu)復有關責任。對列入土(tu)壤(rang)污(wu)染風險(xian)管控和修(xiu)(xiu)(xiu)復名錄的(de)(de)(de)地(di)(di)塊,凡用(yong)(yong)(yong)(yong)(yong)途(tu)調整為住(zhu)宅、公(gong)(gong)共管理與公(gong)(gong)共服(fu)務用(yong)(yong)(yong)(yong)(yong)地(di)(di)的(de)(de)(de),應符(fu)合風險(xian)管控要求、并達到修(xiu)(xiu)(xiu)復目標。


  四、實行差別化土地供應

  鼓勵各地(di)(di)(di)依(yi)據國土空間規劃在(zai)礦(kuang)山修復后土地(di)(di)(di)上發展旅游觀(guan)光(guang)、農業(ye)綜合(he)開(kai)發、養老服務等產(chan)業(ye)。發展旅游、養老服務產(chan)業(ye)涉及(ji)(ji)永久性建(jian)設用(yong)(yong)地(di)(di)(di)的(de),依(yi)法按(an)建(jian)設用(yong)(yong)地(di)(di)(di)管理;利用(yong)(yong)礦(kuang)區自然景觀(guan)及(ji)(ji)農牧漁(yu)業(ye)種植、養殖(zhi)用(yong)(yong)地(di)(di)(di)的(de),可不征收(收回)、不轉(zhuan)用(yong)(yong),按(an)現用(yong)(yong)途(tu)管理;利用(yong)(yong)國有土地(di)(di)(di)建(jian)設非營利性教育、科研、體(ti)(ti)育、公共文化、醫(yi)療衛生、社(she)會福利等符合(he)《劃撥用(yong)(yong)地(di)(di)(di)目錄》的(de)建(jian)設用(yong)(yong)地(di)(di)(di)項(xiang)目,可按(an)有關規定以劃撥方式(shi)提供土地(di)(di)(di)使(shi)用(yong)(yong)權;其(qi)它(ta)符合(he)協議供地(di)(di)(di)條(tiao)件的(de),修復主(zhu)體(ti)(ti)可在(zai)同等條(tiao)件下優先取得土地(di)(di)(di)使(shi)用(yong)(yong)權。


  五、盤活生產建設(she)礦(kuang)山存量建設(she)用地

  鼓勵生產建(jian)(jian)(jian)設(she)(she)(she)礦山邊開采(cai)、邊修(xiu)(xiu)復,依據國(guo)(guo)土(tu)空(kong)間規(gui)劃將(jiang)本(ben)(ben)企(qi)(qi)業(ye)(ye)(ye)廢(fei)棄(qi)的(de)(de)建(jian)(jian)(jian)設(she)(she)(she)用(yong)(yong)(yong)(yong)地(di)(di)(di)修(xiu)(xiu)復為(wei)(wei)農用(yong)(yong)(yong)(yong)地(di)(di)(di)的(de)(de),可(ke)(ke)(ke)按照(zhao)歷史遺留(liu)工礦廢(fei)棄(qi)地(di)(di)(di)復墾利(li)用(yong)(yong)(yong)(yong)試(shi)點(dian)管理(li),按規(gui)定驗(yan)收合格后(hou),騰退出的(de)(de)建(jian)(jian)(jian)設(she)(she)(she)用(yong)(yong)(yong)(yong)地(di)(di)(di)規(gui)模優(you)先(xian)用(yong)(yong)(yong)(yong)于本(ben)(ben)企(qi)(qi)業(ye)(ye)(ye)在(zai)省域(yu)(yu)范圍內(nei)新(xin)(xin)采(cai)礦活動所需建(jian)(jian)(jian)設(she)(she)(she)用(yong)(yong)(yong)(yong)地(di)(di)(di)指(zhi)標(biao),節(jie)余(yu)(yu)指(zhi)標(biao)可(ke)(ke)(ke)在(zai)省域(yu)(yu)范圍內(nei)流轉(zhuan)(zhuan)使(shi)用(yong)(yong)(yong)(yong);修(xiu)(xiu)復成耕(geng)地(di)(di)(di)的(de)(de),按規(gui)定驗(yan)收合格后(hou),可(ke)(ke)(ke)優(you)先(xian)用(yong)(yong)(yong)(yong)于本(ben)(ben)企(qi)(qi)業(ye)(ye)(ye)采(cai)礦活動新(xin)(xin)占(zhan)用(yong)(yong)(yong)(yong)耕(geng)地(di)(di)(di)的(de)(de)占(zhan)補(bu)平衡,補(bu)充耕(geng)地(di)(di)(di)節(jie)余(yu)(yu)指(zhi)標(biao)可(ke)(ke)(ke)以(yi)在(zai)省域(yu)(yu)內(nei)流轉(zhuan)(zhuan)使(shi)用(yong)(yong)(yong)(yong)。在(zai)符合國(guo)(guo)土(tu)空(kong)間規(gui)劃前(qian)提下,經(jing)有(you)批(pi)準權限(xian)的(de)(de)縣級以(yi)上人民政府批(pi)準,礦山企(qi)(qi)業(ye)(ye)(ye)可(ke)(ke)(ke)按市場(chang)價(jia)補(bu)繳(jiao)土(tu)地(di)(di)(di)出讓價(jia)款后(hou),將(jiang)依法取(qu)得的(de)(de)國(guo)(guo)有(you)建(jian)(jian)(jian)設(she)(she)(she)用(yong)(yong)(yong)(yong)地(di)(di)(di)修(xiu)(xiu)復后(hou)用(yong)(yong)(yong)(yong)于商業(ye)(ye)(ye)、服務業(ye)(ye)(ye)等(deng)經(jing)營性(xing)用(yong)(yong)(yong)(yong)途。生產建(jian)(jian)(jian)設(she)(she)(she)礦山將(jiang)廢(fei)棄(qi)國(guo)(guo)有(you)建(jian)(jian)(jian)設(she)(she)(she)用(yong)(yong)(yong)(yong)地(di)(di)(di)修(xiu)(xiu)復后(hou)用(yong)(yong)(yong)(yong)于興辦國(guo)(guo)家支持(chi)新(xin)(xin)產業(ye)(ye)(ye)、新(xin)(xin)業(ye)(ye)(ye)態項目的(de)(de),經(jing)縣級以(yi)上人民政府批(pi)準,可(ke)(ke)(ke)繼(ji)續按原用(yong)(yong)(yong)(yong)途使(shi)用(yong)(yong)(yong)(yong),過渡期為(wei)(wei)5年;過渡期滿后(hou),依法按新(xin)(xin)用(yong)(yong)(yong)(yong)途、市場(chang)價(jia),以(yi)協議方(fang)式重新(xin)(xin)辦理(li)用(yong)(yong)(yong)(yong)地(di)(di)(di)手續。鼓勵生產建(jian)(jian)(jian)設(she)(she)(she)礦山與社會資本(ben)(ben)合作進行(xing)礦山生態修(xiu)(xiu)復利(li)用(yong)(yong)(yong)(yong)。


  六、推(tui)動礦山(shan)修復土地指標交易(yi)

  歷史遺(yi)留礦山廢棄建設(she)用(yong)地(di)(di)或未利用(yong)地(di)(di)修復(fu)為(wei)耕地(di)(di)的,按有關規定(ding)驗收合格后,可(ke)納入補(bu)充耕地(di)(di)儲(chu)備(bei)庫(ku),在省域內流(liu)轉;建設(she)用(yong)地(di)(di)修復(fu)為(wei)農用(yong)地(di)(di)騰(teng)退出的建設(she)用(yong)地(di)(di)指標(biao),可(ke)在省域范圍內流(liu)轉。社會資(zi)本投(tou)入歷史遺(yi)留礦山修復(fu)的,可(ke)按有關規定(ding)或合同(tong)約定(ding)取得(de)各(ge)類指標(biao)流(liu)轉收益。


  七、合理利用廢棄礦(kuang)山(shan)土石料

  對歷史遺留露天開(kai)采類(lei)礦山,因削坡減荷、消(xiao)除地質災害(hai)隱患(huan)等修復(fu)工(gong)(gong)程而(er)產生的土石料(liao),修復(fu)主(zhu)體(ti)可以無償(chang)用(yong)于(yu)本(ben)修復(fu)工(gong)(gong)程,確有剩余的可對外進行銷售,由縣級自然資(zi)源(yuan)(yuan)主(zhu)管(guan)部(bu)門在科學評估(gu)論證(zheng)基(ji)礎(chu)上(shang),按“一礦一策”原則,同步編制利用(yong)方案(an)和修復(fu)方案(an),報市級自然資(zi)源(yuan)(yuan)主(zhu)管(guan)部(bu)門審查同意(yi)后實(shi)施。涉及(ji)對外銷售的,須由縣級人民政府組(zu)織實(shi)施,納入公共(gong)資(zi)源(yuan)(yuan)交易平臺,銷售收益(yi)全部(bu)用(yong)于(yu)本(ben)地區生態修復(fu)。


  八、加強監(jian)督管理

  各級自(zi)然資源主管部門要加強工作指導,做好日(ri)常(chang)監督(du)管理(li),建立(li)健全(quan)政府(fu)、礦山企(qi)業(ye)、社會投(tou)資方、公眾共同參與的(de)監督(du)機制(zhi),探索建立(li)修復(fu)企(qi)業(ye)誠信檔案和(he)信用(yong)積累制(zhi)度,特別要加強礦山修復(fu)形(xing)成(cheng)的(de)農用(yong)地質量監管和(he)涉及廢棄土(tu)石料處置項目的(de)監管,防止各類違(wei)(wei)規違(wei)(wei)法問(wen)題(ti)的(de)發生。


  各(ge)省(區、市)自然(ran)資源主管部門可結合本地實(shi)際(ji),制定具體實(shi)施辦法。實(shi)施過程(cheng)中遇有重大政策問題,及(ji)時向部報告和(he)請示。在國土(tu)空間規劃(hua)(hua)編(bian)制完(wan)成前開展上(shang)述修復工作(zuo)的(de),可以(yi)現有的(de)土(tu)地(di)利用(yong)總體規劃(hua)(hua)、城鄉規劃(hua)(hua)等為規劃(hua)(hua)依據。本意見所稱歷史(shi)(shi)遺留礦山(shan)(shan)(shan),是指由于歷史(shi)(shi)原因(yin)礦山(shan)(shan)(shan)修復(fu)治(zhi)(zhi)理(li)責(ze)任主體(ti)已滅失,應(ying)由地方(fang)政(zheng)(zheng)府負責(ze)修復(fu)治(zhi)(zhi)理(li)的礦山(shan)(shan)(shan)。具體(ti)包括兩類情(qing)形:一(yi)是礦山(shan)(shan)(shan)地質環境(jing)治(zhi)(zhi)理(li)恢(hui)復(fu)保證(zheng)金(jin)制度實施(shi)之前采礦權(quan)已經滅失的礦山(shan)(shan)(shan);二是礦山(shan)(shan)(shan)地質環境(jing)治(zhi)(zhi)理(li)恢(hui)復(fu)保證(zheng)金(jin)制度實施(shi)之后(hou),因(yin)政(zheng)(zheng)策性關閉(bi)(bi)且在關閉(bi)(bi)時地方(fang)政(zheng)(zheng)府已與采礦權(quan)人明確由政(zheng)(zheng)府履行修復(fu)治(zhi)(zhi)理(li)責(ze)任的礦山(shan)(shan)(shan),其中涉及的國有土(tu)地使用權(quan)同時收回。
